TDA+U Terms and Conditions

Welcome to TDA+U, an initiative by The Daily Aus Holdings Pty. Limited ACN 636 427 408 (The Daily Aus).

These terms and conditions (Terms) apply when you agree to make a voluntary contribution to The Daily Aus as part of TDA+U. By contributing to The Daily Aus as part of TDA+U, you acknowledge that you have understood and agree to be bound by these Terms.

The Daily Aus reserves the right to make changes to these Terms at any time, effective upon the publication of the modified terms on this page. By continuing to make Contributions to us, you agree to be bound by the amended Terms.

These Terms were last updated in July 2024.

1. Eligibility

In order to be eligible to make a contribution as part of TDA+U, you must:

  1. (a) be at least 18 years old; and
  2. (b) have a current Australian residential address.

2. Contribution

  1. (a) You may choose whether you make a:
  2. (i) one-off Contribution; or
  3. (ii) a recurring Contribution of your chosen value on a monthly basis.
  4. (b) If you choose to make a one-off Contribution, you will not be required to create an account with The Daily Aus. If you choose to Contribute on a recurring basis, you must create or log into your The Daily Aus account and provide your details for your designated payment method.
  5. (c) Your Contribution is provided to The Daily Aus as an irrevocable gift. You acknowledge that you are making any Contribution voluntarily and that you will not receive any benefits, entitlements, additional content or special access to The Daily Aus as a result of your Contribution and that The Daily Aus is entitled to use your Contribution in any way it sees fit. You acknowledge that you are not entitled to any report or account from The Daily Aus around how it will or does use your Contribution.

3. Payment

  1. (a) You take part in TDA+U by making a voluntary payment to support The Daily Aus.
  2. (b) If you wish to make a recurring Contribution to TDA+U, you agree that you will be billed on a recurring basis on the first day of each monthly billing period and you will pay and authorise Stripe (as our third-party payment processor) to charge your designated payment method the amount of your Contribution. Contributions will continue indefinitely until cancelled by you or us in accordance with these Terms.
  3. (c) You acknowledge and agree that you are responsible for any fees and charges you incur if your Contribution cannot be processed.
  4. (d) You agree that once processed, all Contributions are unconditional and cannot be refunded.
  5. (e) You must provide complete and accurate payment information when you agree to Contribute to TDA+U.
  6. (f) Your payment will be securely processed by Stripe, a third-party payment processor. This payment process will be subject to Stripe's Consumer Terms (available here) and Privacy Policy (available here). You agree that you have read, understood and agree to be bound by the Stripe Payment Method Terms and Privacy Policy.

4. Cancellation and Termination

  1. (a) You are entitled to cancel any recurring Contributions, at any time by logging into your TDA+U account and following the cancellation prompts.
  2. (b) Cancellation will take effect from the end of the relevant billing period in which you cancel your Contribution.
  3. (c) The Daily Aus may suspend or cancel your Contribution at any time, at our sole discretion. If your account is cancelled or suspended, you will not be entitled to make any further Contributions.

5. Tax

The Daily Aus is not a deductible gift recipient for income tax purposes.

6. Privacy

You must:

  1. (a) ensure that all information provided to The Daily Aus is complete, accurate and current (and update such information to ensure that it remains accurate);
  2. (b) ensure that you have reviewed The Daily Aus Privacy Policy (as updated from time to time);
  3. (c) ensure that your login and password details are kept in a secure manner and not shared with anyone else; and
  4. (d) [inform us immediately if you suspect or become aware of unauthorised access to your Reader Revenue account or unauthorised use of your Contribution].

The Daily Aus will take reasonable steps to ensure your account is secure. However, if your account is subject to unauthorised access, The Daily Aus will not be liable in any circumstances for any loss or damage you incur.

7. Intellectual Property

The Daily Aus own (or have obtained the right to use) all data and intellectual property rights existing in or created in relation to The Daily Aus and TDA+U.

You agree not to engage in any screen scraping, data mining or similar data gathering tools or practices to attempt to copy any of the content or data available via The Daily Aus and TDA+U.

8. Liability

To the maximum extent permitted by law, including the Australian Consumer Law, in no event will The Daily Aus be liable for any direct or indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your participation in TDA+U.

9. General

  1. (a) If any part or the whole of these Terms is invalid, illegal or unenforceable, then such provision will be severed. Such severance will not affect the validity or enforceability of the remaining Terms.
  2. (b) If we do not exercise or enforce any right available to The Daily Aus under these Terms, it does not constitute a waiver of such right.
  3. (c) By making a Contribution, you agree you are not engaging in any inappropriate or unlawful conduct.
  4. (d) These Terms are governed by the law of New South Wales.

10. Definitions

The following definitions apply to these Terms:

  1. (a) Contributions means one-off voluntary payments made by you to The Daily Aus as part of TDA+U;
  2. (b) 'The Daily Aus', 'our', 'us' and 'we' means The Daily Aus Holdings Pty Ltd, together with any associated entities; and
  3. (c) 'you' and 'your' means anyone who engages with TDA+U.
